Terms of Service

Acceptance and Scope

These Terms of Service (the “Terms”) govern your access to and use of spritepixel.com, SpritePixel's browser tools, accounts, project workspace and related services (collectively, the “Service”). By using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

You must be old enough to enter into a binding contract where you live. A user who has not reached that age may use the Service only with the consent and supervision of a parent or legal guardian. If you use the Service for an organization, you represent that you have authority to accept these Terms for that organization.

The Service

SpritePixel is an AI game-asset studio for creating character sprites, character variations, animations, sprite sheets, game icons, project asset libraries and exports. Some browser tools may be free. AI generation, private assets, project limits, queue speed and other features may depend on your plan, credits, location and technical availability.

We may add, modify, limit or discontinue features to reflect product, provider or legal requirements. We will provide reasonable notice of material changes where practicable.

Accounts and Security

You must provide accurate account information, protect your credentials and accept responsibility for activity under your account. Contact support@spritepixel.com promptly if you discover unauthorized access, a security issue or an unexpected charge.

Unless we expressly allow it, you may not resell, rent or share an account or use multiple accounts to evade credit, trial, access or security limits.

Credits and Generation Tasks

Some AI features consume credits according to the rules displayed before generation or on the purchase page. Whether downloads, previews or free tools consume credits is determined by the information displayed for that feature at the time of use.

Credits provide a limited right to use features within the Service. They are not deposits, currency or transferable property and cannot be redeemed for cash. Expiration, quantity, eligible features and other credit rules are shown on the purchase page, order or promotion.

If a generation fails because of a confirmed SpritePixel, AI-provider or system error, we will return the corresponding credits under the failure-handling rules then in effect. A prompt, reference, network condition, user action, policy violation or result that does not meet a user's subjective expectations does not necessarily qualify as a failed generation or refund event.

Your Content and Reference Material

You retain the rights you have in prompts, project settings, reference images and other content you upload. You represent that you have the rights, licenses and permissions required to upload, process and use that content and that it does not infringe another person's intellectual property, privacy, publicity or other rights.

You authorize SpritePixel and the providers supporting infrastructure, storage, authentication, payments and AI generation to host, copy, transmit, transform and process that content as needed to operate, secure, troubleshoot and improve the Service. This permission does not transfer to you or SpritePixel any third-party rights you do not already have.

Do not submit unnecessary sensitive personal information, trade secrets or confidential material that you are not authorized to process in prompts or reference images.

Generated Assets and Commercial Use

Subject to these Terms, the purchase-page terms, applicable AI-provider terms and rights in your reference material, you may use generated assets in personal or commercial game projects.

AI output may resemble output created for other users and may contain errors, defects or elements affected by third-party rights. SpritePixel does not guarantee uniqueness, registrability, non-infringement or fitness for a particular purpose. You are responsible for reviewing output and obtaining professional advice or additional permissions where appropriate before publishing, selling or integrating it into a game.

Public and Private Assets

Default asset visibility depends on the plan in effect when an asset is created. Under the current purchase-page terms, assets created by Free accounts and credit-pack-only accounts may be public by default, while an active paid subscription may provide private-by-default assets. A purchase, cancellation or plan expiration does not automatically override visibility rules previously disclosed for an asset.

Check the current plan description before uploading or generating content. Do not submit confidential, personal or restricted content to a project that may be public. Visibility controls may be available, but we cannot guarantee immediate removal of copies already cached by search engines, third parties or prior lawful visitors.

AI Models and Access Providers

SpritePixel uses third-party AI APIs for image generation and related features. As of the effective date shown at the top of this page, the production Service calls the following models and access sources:

We may add, replace or retire models or providers to maintain quality, safety, cost and legal compliance. When we make a material change to the primary image-generation model or access provider used for paid AI features, we will update this section and publish a new effective date on this page where practicable.

Generated output is also subject to the safety and use policies of the underlying providers, in addition to the Acceptable Use Policy below.

Acceptable Use Policy for AI-Generated Content

This section applies to prompts, reference images, uploads, exports and AI-generated outputs. It forms part of these Terms.

Prohibited content

You must not use the Service to create, upload, request, store, share, export or distribute content that includes or promotes:

1. Sexual or NSFW content — pornography, explicit nudity intended to arouse, or other sexually explicit material.
2. Graphic violence or gore — extreme violence, torture, or disturbing gore created to shock or glorify harm.
3. Hate speech — content that attacks, dehumanizes or incites violence or discrimination against individuals or groups based on protected characteristics.
4. Child safety violations — sexualization of minors, child sexual abuse material (CSAM), or any content that endangers minors.
5. Deepfakes and impersonation — synthetic media intended to deceive others about a real person's identity, or non-consensual impersonation of a real person (including public figures) in a harmful or fraudulent manner.

This list is in addition to, and does not limit, the general prohibitions elsewhere in these Terms or applicable law.

Reporting violations

If you believe a user, prompt, upload or output violates this policy, email support@spritepixel.com with:

• the account email (if you have an account);
• the project name, generation task ID, page URL or approximate date and time;
• a clear description of the concern; and
• screenshots or other supporting information where available.

We may request additional details. Do not attach unlawful material in a report when a description is sufficient.

Content moderation and enforcement

SpritePixel uses a layered approach to content safety:

• Automated safeguards — provider-side safety filters, rate limits, logging and abuse-prevention controls on generation tasks;
• Review and enforcement — investigation of credible reports and suspicious activity; removal or restriction of content; suspension or termination of accounts; refunds are handled only under the failure-handling rules in these Terms, not for policy violations;
• Records — retention of generation and security logs as described in the Privacy Policy for investigation and legal compliance.

We may block or remove prompts or outputs that appear to violate this policy or provider rules before or after generation. No moderation system is perfect; you remain responsible for your use of the Service.

Prohibited Use

You may not:

• use the Service in violation of law, regulation or third-party rights;
• upload malware, unlawful harmful material or unauthorized personal, confidential or protected content;
• bypass credits, payments, access controls, rate limits or security measures;
• scrape, attack, reverse engineer or otherwise disrupt the Service, except where applicable law expressly permits it;
• access another user's private project, account or non-public data;
• impersonate another person, commit payment fraud, abuse refunds or create duplicate accounts to obtain improper benefits; or
• generate, distribute or sell content in a manner prohibited by an applicable provider or law, including the Acceptable Use Policy for AI-Generated Content above.

We may restrict, remove, suspend or terminate content or accounts suspected of violating these rules and may preserve or disclose necessary records when legally required.

Subscriptions, Cancellation and Refunds

1. Subscriptions and Automatic Renewal

Some SpritePixel services are offered by subscription. After you purchase a subscription, it automatically renews at the end of each billing period and charges your selected payment method for the next period unless you cancel before renewal.

The price, billing interval, included credits, credit validity and benefits are the terms shown on the purchase page and order confirmation. You are responsible for reviewing the order and applicable taxes before purchase.

2. Cancellation

You may cancel through the billing-management option in your account or the option provided by the applicable payment provider. If that option is unavailable, contact support@spritepixel.com.

Cancellation does not normally end an already-paid subscription immediately. Unless a refund, payment dispute, policy enforcement action or purchase-page term states otherwise, you may continue using the applicable subscription benefits until the end of the current billing period. The subscription will then stop renewing and no further subscription fee will be charged.

Cancellation by itself does not automatically refund an amount already paid.

3. First-Subscription Refund

For the first paid subscription purchased on an account, you may request a refund within 7 days of purchase by emailing support@spritepixel.com. Include the account email, order number, purchase date and reason for the request so we can verify the order.

If you have not used any credits included with that subscription, we will generally refund the amount actually paid for the subscription. If some included credits have been used, the maximum refund is calculated from the unused proportion:

Refundable amount = amount actually paid × unused subscription credits ÷ credits included with the subscription

For example, if the subscription included 1,000 credits and 300 credits had been used when the request was made, the maximum refund would be 70% of the amount actually paid. If all or substantially all included credits have been used, the order may not qualify for a refund.

After approval, remaining subscription credits and unvested benefits associated with the refunded order may be removed. Credits used while a request is under review may reduce the final refund. Suspected fraud, refund abuse, a violation of these Terms or an order already subject to a chargeback may be ineligible for this voluntary policy, except where applicable law requires otherwise.

4. Promotional Credits

Credits provided free through a promotion, discount, reward, goodwill adjustment or other offer have no cash value and are not included in a refund calculation. Remaining promotional credits associated with a refunded order may also be removed.

5. Subscription Renewals

Completed subscription renewals are generally non-refundable. Cancel before the next billing period begins if you do not want the subscription to continue.

Contact us promptly about duplicate charges, system billing errors, unauthorized payments or other abnormal transactions. We will review the order, credit usage and payment records. This does not limit rights available to you under applicable law.

6. One-Time Credit Packs

For a separately purchased credit pack or another one-time digital service:

• if no credits from that order have been used, you may contact us for refund review;
• once credits from that order have been used, the purchase is generally non-refundable;
• free or promotional credits cannot be redeemed for cash or refunded; and
• mandatory refund rights under applicable law always take priority.

7. Refund Method and Timing

Approved refunds are normally returned to the original payment method. Processing time depends on the payment platform, bank or other payment-service provider. If the original method cannot receive a refund, we may offer another reasonable method based on the circumstances.

Exchange-rate changes, bank charges or provider fees outside our control may cause the amount received to differ from the amount initiated.

8. Statutory Rights

If consumer-protection law in your country or region provides a non-waivable cancellation right, refund right, digital-content protection or other statutory remedy, that law controls to the extent it conflicts with these Terms.

Payments, Taxes and Chargebacks

Payments are processed by the third-party provider displayed at checkout. You authorize that provider to charge the amount stated in the order and subscription terms. Unless checkout states otherwise, prices may exclude taxes applicable in your location.

Please contact us first if you believe a payment is incorrect. A fraudulent chargeback or a chargeback initiated without reasonable communication may result in limits on the account, credits or Service access. This does not prevent you from raising a legitimate dispute with a payment institution where permitted by law.

SpritePixel Intellectual Property

The SpritePixel website, brand, interface, software, documentation and other content provided by us or our licensors are protected by intellectual-property law. Except for the limited rights needed to use the Service, these Terms do not transfer those rights to you. You may not copy, sell, sublicense or create a competing derivative service without permission, except where applicable law expressly permits it.

Third-Party Services

The Service may depend on AI models, payments, authentication, storage, email and other third-party services. Those services are governed by their own terms and privacy policies. Their availability, processing time and output are not entirely controlled by SpritePixel. For the image-generation models and API sources we currently use in production, see AI Models and Access Providers above.

Availability and Disclaimers

To the extent permitted by law, the Service is provided on an “as is” and “as available” basis. We do not guarantee that it will always be uninterrupted, error-free or completely secure, or that AI output will meet your subjective requirements or a particular platform's technical, commercial or legal requirements.

You are responsible for keeping necessary local copies and reviewing files, animations, copyright, trademarks, likenesses and other risks before using, publishing or selling an asset in a game.

Limitation of Liability

To the maximum extent permitted by applicable law, SpritePixel and its service providers are not liable for indirect, incidental, special, consequential or punitive damages arising from use of or inability to use the Service, including loss of profit, data, goodwill or business opportunity.

Nothing in these Terms excludes or limits liability, consumer rights or remedies that cannot legally be excluded or limited.

Suspension and Termination

You may stop using the Service at any time. We may limit, suspend or terminate an account or feature if you violate these Terms, present a security or payment risk, if required by law or a provider, if the Service is discontinued, or when necessary to protect users and third parties.

After termination, your right to use the Service ends. Payment records, dispute handling, intellectual property, disclaimers, liability limitations and provisions that by their nature should survive remain effective. Content deletion and record retention are governed by the Privacy Policy and applicable law.

Changes and Severability

We may update these Terms and post a new effective date on this page. Where practicable, we will notify you of material changes through the website, an in-product notice or the email associated with your account. Continued use after the changes take effect means you accept the revised Terms.

If any provision is found invalid or unenforceable, the remaining provisions remain in effect and the invalid part will be adjusted only to the minimum extent permitted by law.

Disputes and Applicable Law

We encourage you to contact support first if a dispute occurs. Applicable law, venue and mandatory consumer protections depend on the transaction entity, your location and relevant law. These Terms do not remove rights that cannot legally be waived by contract.
